1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of all websites, platforms, products, services, content, communications, and offerings operated or published by Goshen Legacy™ LLC (“Company,” “we,” “us,” or “our”).

By accessing, viewing, downloading, purchasing, submitting information to, interacting with, or otherwise using any Company content or services, including websites, digital or physical products, educational resources, courses, consulting services, podcasts, social media channels, community spaces, email communications, or third-party distribution platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not access or use Company content or services.

2. Entity Scope and Covered Divisions

These Terms apply to all current and future operations of Goshen Legacy™ LLC, including but not limited to:

Policy Clarity Solutions™
Layers of H.E.R.™
Goshen Legacy Academy
Books, publications, and media products
Digital resources and downloads
Courses, programs, workshops, and webinars
Consulting, advisory, and educational services

Division-specific clarifications regarding delivery, scope, or requirements are included in the Division Addenda below and are incorporated into these Terms by reference.

3. Products and Services – Educational Scope

Goshen Legacy™ LLC, operating through its divisions including Policy Clarity Solutions™, provides independent educational and consulting services designed to help individuals and small businesses interpret insurance policies, coverage terms, and general risk exposures for the purpose of improving insurance literacy and informed decision-making.

The Company does not sell, solicit, place, bind, underwrite, or adjust insurance policies and does not represent any insurance carrier, agent, or broker.

ALL OFFERINGS ARE PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE LEGAL, INSURANCE, FINANCIAL, TAX, MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL ADVICE.

Clients are solely responsible for verifying coverage, confirming suitability, and executing all insurance-related decisions with licensed agents, brokers, or carriers. No recommendations, examples, explanations, or educational materials provided by the Company replace the need for professional, licensed advice.

4. User Responsibilities and Conduct

You agree to use Company platforms lawfully and in good faith and not to:

Misrepresent information
Harass, abuse, defame, or exploit others
Engage in fraudulent, deceptive, or unlawful conduct
Copy, resell, distribute, or commercially exploit Company content without authorization

The Company reserves the right, in its sole discretion, to restrict, suspend, or terminate access for violations of these Terms or misuse of Company platforms.

5. Payments, Platforms, and Fulfillment

Payments may be processed through third-party platforms and processors, including but not limited to Podia, Stripe, PayPal, Amazon, and other authorized providers.

Fulfillment methods vary by product and may include digital delivery, physical shipment, written reports, recorded or live access, or scheduled services.

6. STRICT NO-REFUND POLICY, FINAL SALE, AND THIRD-PARTY PLATFORM LIMITATIONS

ALL SALES ARE FINAL.
Due to the immediate digital delivery of intellectual property, proprietary frameworks, educational content, and/or access to services, GOSHEN LEGACY™ LLC DOES NOT OFFER REFUNDS, CREDITS, OR EXCHANGES UNDER ANY CIRCUMSTANCES.

Immediate Performance and Waiver

By completing a purchase, you expressly request and consent to immediate performance and delivery of digital content and services and waive any statutory cooling-off, rescission, or cancellation periods to the fullest extent permitted by law.

Third-Party Platform and Vendor Disclaimer

Goshen Legacy™ LLC is not responsible for delays, interruptions, access issues, data loss, payment failures, or service disruptions caused by third-party platforms or vendors, including but not limited to Podia, Stripe, PayPal, Amazon, hosting providers, email service providers, content delivery networks, or document-hosting services.

Issues arising from third-party platforms do not constitute grounds for a refund.

Limited Technical Exception (Company-Side Only)

Refunds are only considered if a verified technical failure solely attributable to the Company prevents access to purchased content for more than forty-eight (48) consecutive hours and the issue cannot be resolved by the Company’s support team.

The following do not qualify for refunds:

Third-party platform outages or errors
Internet, device, or browser issues
Payment processor delays or holds
Failure to complete required intake or preparation steps
Dissatisfaction, misuse, or change of mind

7. Chargebacks and Payment Disputes

You agree not to initiate a chargeback or payment dispute without first contacting contact@thegoshenlegacy.com to attempt resolution.

Unauthorized chargebacks may result in suspension or termination of access. The Company may submit transaction records, delivery confirmation, and acceptance of these Terms to payment processors in response to disputes.

8. Intellectual Property and Proprietary Frameworks

All content, materials, frameworks, methodologies, systems, processes, templates, diagnostic logic, intake structures, analytical models, educational sequencing, question design, reports, guides, checklists, tools, branding, trademarks, logos, audio, video, written works, and business methods, whether delivered digitally, verbally, visually, live, or asynchronously, are the exclusive intellectual property of Goshen Legacy™ LLC.

This includes, without limitation, all proprietary frameworks and structured approaches developed, used, or delivered through Goshen Legacy™ LLC and its divisions, including Policy Clarity Solutions™ and Layers of H.E.R.™, whether or not such frameworks are formally named, trademarked, or registered.

Ownership of all intellectual property remains solely with Goshen Legacy™ LLC at all times. Access to or use of Company content or services does not grant, assign, transfer, license, or imply any ownership interest or intellectual property rights to the user.

8A. Limited License and Permitted Use

Subject to compliance with these Terms, Goshen Legacy™ LLC grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Company content solely for your personal, internal, educational, and non-commercial use.

Unless expressly authorized in writing by Goshen Legacy™ LLC, you may not:

Apply Company frameworks, methodologies, or systems in client-facing, commercial, ministerial, consulting, coaching, advisory, training, or professional services
Teach, train, certify, mentor, or instruct others using Company content or frameworks
Incorporate Company materials into your own programs, courses, services, products, or offerings
Share, distribute, sell, license, or otherwise make Company content available to any third party

Any use beyond the limited license granted herein constitutes unauthorized use and infringement.

8B. Prohibited Conduct and Competitive Use Restriction

You agree not to, directly or indirectly:

Reverse engineer, deconstruct, analyze, map, extract, or attempt to recreate Company frameworks, systems, methodologies, or business logic
Develop derivative works, competing frameworks, or substantially similar offerings based on Company content or services
Use Company materials for competitive benchmarking, internal training, or replication purposes
Hold yourself out as trained, certified, or endorsed by Goshen Legacy™ LLC unless expressly authorized in writing
Use insights gained through Company services to create, enhance, or support competing educational, consulting, media, or advisory offerings

These restrictions apply regardless of whether the content is modified, paraphrased, reorganized, or combined with other materials.

8C. Centralized Intellectual Property Ownership Across Divisions

All intellectual property created, developed, delivered, or used by any division, program, product line, or brand operated by Goshen Legacy™ LLC, including Policy Clarity Solutions™, Layers of H.E.R.™, and Goshen Legacy Academy, is and shall remain the sole property of Goshen Legacy™ LLC.

No division, collaborator, contractor, participant, or contributor acquires any ownership interest in Company intellectual property by virtue of participation, contribution, engagement, or access.

8D. Survivability and Enforcement

All intellectual property obligations, use restrictions, and prohibitions set forth in these Terms survive termination of access, completion of services, account closure, refund disputes, or cessation of any relationship with the Company.

Unauthorized use of Company intellectual property constitutes irreparable harm. Goshen Legacy™ LLC is entitled to immediate injunctive and equitable relief, in addition to all other remedies available at law or equity, including recovery of attorneys’ fees, costs, and damages, without the requirement to post bond.

9. Social Media and Third-Party Platforms

Company content, products, and services may be hosted on or distributed through third-party platforms, including but not limited to Podia, Apple Podcasts, Spotify, YouTube, Instagram, and Facebook.

Your interaction with the Company through third-party platforms is governed by both these Terms and the applicable platform’s terms, policies, and community guidelines.

The Company is not responsible for platform outages, moderation decisions, account restrictions, content removal, algorithm changes, or technical failures of third-party platforms.

10. Third-Party Educational Partners and Resources

Certain educational content, courses, or resources made available through Goshen Legacy Academy may be hosted by or provided through third-party organizations, including BiblicalTraining.org.

BiblicalTraining.org is an independent third-party provider and is not owned, operated, or controlled by Goshen Legacy™ LLC. Access to third-party resources is governed by the terms, policies, and privacy practices of the respective provider.

Goshen Legacy™ LLC does not warrant, endorse, or assume responsibility for the accuracy, completeness, availability, or outcomes of third-party content.

11. User-Generated Content & Testimonial Consent

By submitting comments, feedback, reviews, applications, or other content, or by participating in recorded sessions, interviews, or educational services, you grant Goshen Legacy™ LLC a non-exclusive, royalty-free, worldwide license to use such content for educational, editorial, marketing, and business purposes.

This consent includes, but is not limited to, the following:

Usage
Use of anonymized or generalized feedback and insights for staff training, internal analysis, program development, quality improvement, and marketing that promotes Policy Clarity Solutions™ and other Company offerings.

Identification
Testimonials may identify you by first name and last initial, first initial and last name, or business name, unless you notify the Company in writing that you prefer full anonymity.

Privacy Safeguard
Personally identifying details, including but not limited to specific addresses, policy numbers, claim numbers, or financial account information, will never be shared in marketing or public materials without your explicit written consent.

Revocation of Consent
You may revoke testimonial consent in writing at any time; however, revocation does not apply to materials produced, published, or distributed prior to the Company’s receipt of such notice.

All insights, analyses, summaries, interpretations, educational outputs, or derivative materials created by the Company in connection with user submissions, services, or engagements remain the exclusive intellectual property of Goshen Legacy™ LLC, even if informed by user-provided information.

12. Artificial Intelligence and Accuracy Disclaimer

The Company may use artificial intelligence tools to assist with content creation, analysis, administrative processes, or operational efficiency.

The Company does not warrant the absolute accuracy, completeness, or suitability of AI-assisted or AI-generated output. Users are responsible for independently verifying information before reliance.

AI tools do not replace professional judgment or licensed expertise.

13. Privacy Policy

Your use of Company platforms is governed by the Privacy Policy, which is incorporated by reference and available on the published Privacy Policy page.

14. Limitation of Liability & Client Responsibility

To the fullest extent permitted by law, Goshen Legacy™ LLC, its sole member, officers, employees, contractors, volunteers, interns, representatives, collaborators, and guests shall not be liable for any financial, insurance, business, or personal decisions made based on Company content, sessions, or educational materials.

No specific insurance outcome, coverage determination, claim result, financial impact, or business result is guaranteed.

All services, resources, and content are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied.

15. Rogue Agent and Independent Conduct Clause

Any individual associated with Goshen Legacy™ LLC, including employees, contractors, interns, volunteers, or collaborators, who engages in conduct that is illegal, fraudulent, unauthorized, or contrary to Company policies is acting outside the scope of their authority.

Such individuals are personally and solely responsible for their actions and agree to indemnify and hold harmless Goshen Legacy™ LLC from any resulting claims, losses, damages, or liabilities.

16. Dispute Resolution and Class Action Waiver

Any dispute arising out of or relating to these Terms or Company services must first be addressed informally by contacting contact@thegoshenlegacy.com.

If unresolved, disputes shall be resolved through binding arbitration conducted in the State of Florida, in accordance with the rules of the American Arbitration Association.

All disputes must be brought on an individual basis only. You waive the right to participate in any class, collective, or representative action.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

19. Updates to Terms

The Company reserves the right to update or modify these Terms at any time. Continued access or use of Company content or services constitutes acceptance of the revised Terms.

20. Force Majeure

The Company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, hurricanes, floods, fires, power outages, war, terrorism, riots, embargos, acts of civil or military authorities, accidents, pandemics or epidemics including COVID-19 related disruptions, network or infrastructure failures, or labor disputes.
